Terms of use
Last updated 23 October 2026
These terms are an agreement between you and GOL Productions, trading as Vyndigital, a business run by a sole trader in Western Australia, Australia. Vyndigital and Pencil are GOL Productions brands. Payments are made to GOL Productions and appear under that name. They cover your use of Pencil, the drawing service on this site. By getting a key or using Pencil, you agree to them. If you don't agree, don't use Pencil.
1. What Pencil is
Pencil is an MCP service. It lets an AI assistant you choose draw pictures by sending drawing instructions to our server, which renders them and sends back the picture. Vyndigital is not affiliated with, endorsed by or connected to any AI assistant provider.
2. Who can use it
You must be 18 or over, or have a parent or guardian's permission. If you use Pencil for a business, you confirm you can agree to these terms for it.
3. Plans and limits
- Trial: 10 drawings in total, no card needed.
- Pro: $28 USD (US dollars) a month for 100 drawings a day. The daily count resets at 00:00 UTC. Unused drawings don't carry over.
- Drawing a new picture and editing a picture each count as one drawing. A drawing that fails is not counted. Looking at a drawing (zooming in) and checking it for mistakes are free; looking is limited to 300 times a day to keep the service fast for everyone.
- Each account is limited to 3 drawing requests a second.
Prices are in US dollars. If your card is in another currency, your bank may add a conversion fee.
4. Your account and keys
You need an account to use Pencil. Give a real email address, keep your password private, and don't share your account. You're responsible for what happens under your account and its keys.
API keys connect Pencil to your AI. Each key is shown once, when you create it. Keep keys secret: anyone with a key can use your account's drawings and see what it has drawn. If a key leaks, revoke it from your dashboard straight away and create a new one. One person or business per account. Don't share, sell or resell accounts, keys or access.
5. Acceptable use
Don't use Pencil to:
- make anything illegal, anything that sexualises minors, or anything that harasses, threatens or promotes violence against people;
- copy or imitate someone else's logo, trade mark or artwork, or otherwise infringe their rights;
- place images you don't have the right to use;
- attack, overload, probe or get around the limits or security of the service, or reverse engineer it.
If an account or key breaks these rules, we may suspend or close it. Unless it's urgent, illegal or a security risk, we'll email you first, tell you why, and give you a chance to respond. If we close a Pro account that hasn't seriously broken these terms, we'll refund the unused part of your month.
6. Pencil is a tool
Pencil is a drawing tool. It draws exactly what it's instructed to draw, and it doesn't decide what to make. Like a pen, a hammer or design software, what you do with it is your responsibility.
- Your inputs. You're responsible for the instructions you or your AI send to Pencil and for any images you place. You confirm you have the right to use them and that they don't break the law or anyone's rights.
- Your outputs. You're responsible for how you use what Pencil draws: where you publish it, what you sell it as, and whether it clashes with someone else's logo, trade mark or artwork. Check a logo or brand mark before you rely on it, for example on the IP Australia trade marks register.
- Not unique. Someone else's AI may draw something similar to yours. We don't promise any drawing is unique or exclusive.
- Rights in drawings. As between you and us, what you make is yours, and we give you any rights we have in it. We can't promise it's protected by copyright: in Australia, work made by an AI may not be.
- Our part. We're responsible for Pencil itself: running the service and rendering what it's sent. We claim no rights in your drawings beyond storing and processing them to run the service.
- Keep your own copies. We store your drawings so your AI can work on them, but Pencil isn't a backup service. Download anything you need to keep.
If you break these terms or use Pencil to infringe someone's rights, and that causes a claim against us, you agree to cover our reasonable costs of that claim, to the extent it was caused by you.
7. Reporting misuse
If you believe something made with Pencil infringes your rights or breaks the law, email contact@golproductions.com with the details. We may remove stored drawings and suspend keys involved in misuse.
8. Payments and cancelling
Pro is billed monthly in advance through Stripe until you cancel. Cancel any time from your dashboard, or by emailing us. Cancelling stops the next charge, and Pro stays active until the end of the month you paid for. Payments are not refundable for change of mind, except as required by law. See the refund policy.
9. Availability and changes
We work to keep Pencil running, but we can't promise it will never be down, slow or have errors. We do planned maintenance at quiet times, and we'll email Pro users before any planned work expected to take more than an hour. Some outages come from things outside our control, such as our hosting provider, internet problems or attacks on the service. We'll restore Pencil as soon as we reasonably can. We don't give refunds or credits for downtime, slowness or errors, except where the Australian Consumer Law requires it. We may improve or change features. We'll email Pro users at least 14 days before a price change, or a change that materially reduces what Pro includes, and you can cancel before it applies. If you cancel because of that change, we'll refund the unused part of your month.
10. Liability
Pencil comes with guarantees under the Australian Consumer Law that can't be excluded. Nothing in these terms limits them.
Apart from those guarantees, and as far as the law allows: we're not liable for indirect or consequential loss, such as lost profits, lost data, or what another service would have cost you, and our total liability to you is limited to the fees you paid us in the 1 month before the claim. Pencil is a tool, and these limits reflect its price. Where the law lets us limit our liability for failing a consumer guarantee, it's limited to supplying the service again, or paying the cost of having it supplied again.
11. Changes to these terms
We may update these terms, and the date at the top shows when they last changed. If a change reduces your rights, we'll email Pro users at least 14 days before it applies, and you can cancel before then and get a refund for the unused part of your month. Changes that only add to your rights, or that the law requires, can apply straight away.
12. Ending
You can stop using Pencil and delete your account at any time from your dashboard. We may end these terms if you seriously break them, or if we stop running Pencil. If we stop running Pencil, we'll give Pro users at least 30 days' notice and refund unused paid time.
13. Law
These terms are governed by the law of Western Australia, Australia.
